Introduction to the Terms of Use

Article 1 – Introduction and Definitions

The above introduction forms an integral part of this agreement. The following terms and definitions shall apply to the principal expressions used in this agreement:

Store: This includes all forms of the store on the internet, whether as an electronic application, a website, or a physical commercial outlet.
Consumer: Any person who engages in e commerce for the purpose of obtaining the products or services offered by the store through its electronic platform.
Agreement: The terms and conditions of this agreement, which govern and regulate the relationship between the parties to this agreement.

Article 2 – Consumer Legal Capacity

The consumer acknowledges that they have the legal capacity, in accordance with Sharia and applicable laws, to deal with the store, or that they are at least eighteen years old.
The consumer agrees that if they violate this article, they shall bear the consequences of such violation before third parties.

Article 3 – Nature of the Store’s Commitment

The store’s obligation toward consumers is to provide the service or product.
The store may also provide other services, such as after sales services or related services, depending on the nature and type of the requested service or product.

Article 4 – Rules of Use

The consumer shall use the store’s electronic platform in a manner consistent with public morals and the laws and regulations in force in the Kingdom of Saudi Arabia.
When purchasing a product or service from this store, the consumer shall not use such product or service in any manner that violates public morals or the laws and regulations in force in the Kingdom of Saudi Arabia.

Article 5 – Accounts and Registration Obligations

Upon applying to join the store as a user, you are required to provide specific information and choose a username and a confidential password for access to the store’s services. By doing so, you agree to the following:

You are responsible for maintaining the confidentiality of your account information and password, and you agree to notify the store immediately of any unauthorized use of your account information or any other breach of confidentiality.
The store shall not under any circumstances be liable for any direct or indirect loss, whether moral or material, resulting from the disclosure of the consumer’s username or password.
You undertake to use your account or membership personally, and you bear full responsibility for it. If another person uses it, this shall be deemed evidence that you have authorized them to use the store in your name and on your behalf.
You undertake to use the store seriously and in good faith.
You undertake to provide true, accurate, current, complete, and lawful information about yourself as required during registration, and to update your information whenever it changes or whenever necessary.
Our store is committed to treating your personal information and contact details with complete confidentiality.
If the store determines that you have disclosed information that is untrue, inaccurate, outdated, incomplete, unlawful, or in violation of these Terms of Use, the store shall have the right to suspend, freeze, or cancel your membership, store, or account on the platform, without prejudice to the store’s other rights and lawful means of recovering its rights and protecting other consumers.
In the event of non compliance with any of the above, the store management shall have the right to suspend or cancel your membership or prevent you from accessing the store’s services again.

Article 6 – Electronic Communications and Official Means of Contact

The parties to this agreement agree that communication shall be made via the email address registered on the platform.
The consumer agrees that all agreements, announcements, statements, and other communications provided electronically shall have the same legal effect as written communications and shall constitute valid evidence in meeting legal and Sharia requirements.
The consumer agrees that they may be contacted and notified of any provisions relating to this agreement or their dealings with the store through general messages sent by the store management to all consumers or to specific users of the store.

Article 7 – Amendments to the Terms of Use and Fees

If any provision or clause of this agreement is canceled or becomes unenforceable, this shall not affect the validity of the remaining provisions, clauses, rules, and terms of this agreement, which shall remain in force until further notice from the store management.
This agreement, as amended from time to time as circumstances require, constitutes the mechanism of operation, understanding, and agreement between the consumer and the store.
The store may impose fees on some consumers depending on the offers, products, or services requested, or on any fees or taxes imposed by the state on the nature of the product or service.
The store reserves the right to add, increase, reduce, or deduct any fees or expenses under the provisions and terms of these Terms of Use for any consumer, regardless of the reason for their registration.

Article 8 – Payment Services

Through its partners, the store provides payment and settlement services, which may be carried out entirely online through the payment options available on the store or through any payment method the store may provide from time to time.
The store shall determine the price of the service or product displayed in the store according to the prevailing market value.
The store shall provide invoices, receipts, and delivery records for all amounts and profits generated in the store, and shall provide the consumer with an invoice for the purchase of any service or product.
The store shall provide generally accepted accounting standards in its online store in accordance with the provisions of this agreement, in view of the legal, economic, commercial, and organizational interests served by such arrangement.

Article 9 – Intellectual Property

The intellectual property rights of the store are fully owned by the store, whether such rights existed before or after the establishment of this electronic platform.
The consumer shall respect the intellectual property rights of the store, including the store name itself, words, logos, symbols, and other elements belonging to or displayed by the store, as all rights associated with the store name are fully owned intellectual property rights of the store.

Article 10 – Store Responsibility

The store undertakes to conduct its business through this electronic platform in a lawful manner and in accordance with the laws and regulations in force in the Kingdom of Saudi Arabia and the provisions of this agreement.
The store shall not be liable for any claims arising from errors or negligence, whether directly, indirectly, incidentally, by the consumer, or by a third party such as shipping companies.
(Store Name), its staff, owners, and representatives undertake that the product or service shall be lawful, permitted, and authorized in accordance with the laws and regulations of the Kingdom of Saudi Arabia and shall be used for lawful purposes.

Article 11 – Restriction of Access or Membership

The store may suspend or cancel the consumer’s membership or restrict the consumer’s access to the platform’s services at any time, without notice, for any reason, and without limitation.

Article 12 – Governing Law

These Terms of Use are governed by and drafted in accordance with the laws, regulations, and legislation in force in the Kingdom of Saudi Arabia, and are fully subject to the regulations enforced by the competent authorities in the Kingdom of Saudi Arabia.

Article 13 – General Provisions

If any provision or clause in these Terms of Use is canceled or becomes unenforceable, this shall not affect the validity of the remaining provisions, clauses, and terms, which shall remain in force until further notice from the store management.

These Terms of Use, as may be amended from time to time as circumstances require, constitute the agreement, mechanism of operation, understanding, arrangement, and contractual relationship between the store and the consumer. Both parties agree that the following shall be taken into consideration:

Arabic shall be the governing language for interpreting the provisions of this agreement or translating it into any other language.
All prices displayed for the store’s services or products may be amended from time to time.
Any promotional or marketing offers introduced by the store are temporary offers, and the store has the right to amend or discontinue them at any time.
The parties to this agreement shall deal with each other in a manner that does not violate Sharia rules, laws, and regulations applicable to the nature of the relationship between the store and the consumer.
These Terms of Use may only be canceled by a decision issued by the store management.
